You understand that Trans n Trip is only a facilitator between you and the various “Hotel Owners”/”Service Providers” in making the reservations on your behalf. This website facilitates in arranging your travel and holiday packages, airline booking, obtaining hotel reservation which are provided by Hotel Owners (hereafter referred to as “Services”); and these services are strictly non-refundable even if you prefer to cancel your booking at any time. Trans n Trip shall only facilitate in arranging such services.

FOR CUSTOMERS As a condition of your use of this Website, you warrant that:

i. you have attained the legal age of 18 years and eligible execute any agreement or a binding contract;
ii. you hereby agree to use this Website in accordance with the Terms of Use as well as its Privacy Policy;
iii. You will use this Website only to make legitimate reservations for yourself or for another person for whom you are legally authorized to act;
iv. you will inform such other persons about the Terms of Use that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto;
v. all information supplied by you on this Website is true, accurate, current and complete, and;
vi. if you have an online account with this Website, you will safeguard your account information and will supervise and be completely responsible for any use of your account by you and anyone other than you.
vii. You shall not share the Password as well as other log in details of your account on this website and shall also not use the credit cards or other such plastic money or payment methods, for which you have not been authorized.
viii. You shall not make any fraudulent transaction either by e-transaction using the password or access codes of any other person.

Trans n Trip retains the right in our sole discretion to deny access to anyone to this Website and the services we offer, at any time without notice and for any reason, including, but not limited to, for violation of these Terms of Use.

DETAILS REQUIRED FOR CREATING A LOG IN ACCOUNT

While creating a log in account on the Website, you shall provide your complete name, telephone numbers, mobile number, credit card details or other such payment services, age, address. You hereby warrant that the details provided by you are correct in all respect without any manipulation or fraud. Any usage of services offered by this Website is subject to the creation of log in account in your name. Before creating a log in account in your name, you must read the Terms and Conditions as well as the Privacy Policy for use of Website and agree to the same.

ACTIVITIES PROHIBITED ON USE OF WEBSITE

Additionally, you agree not to:

ii. Make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;
iii. Access, monitor or copy any content or information of this Website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;
iv. Violate the restrictions in any robot exclusion headers on this Website or bypass or circumvent other measures employed to prevent or limit access to this Website;
v. Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;

If any activity through your log in account shows signs of fraud, abuse, or suspicious activity, Trans n Trip may cancel any reservations associated with your name, email address, or account, and close any associated Trans n Trip accounts. In addition, Trans n Trip may verify (i.e. preauthorize) your credit card. If you have conducted any fraudulent activity, Trans n Trip reserves the right to take any necessary legal action and you may be liable for monetary losses to Trans n Trip, including litigation costs and damages. To contest the cancellation of a booking or freezing or closure of an account, please contact Trans n Trip Customer Service.

APPLICABILITY OF THIRD PARTY & SUPPLIER RULES AND RESTRICTIONS

You agree that Trans n Trip is only the facilitator connecting you and the Service provider including Transport, Airline, Sight Seeing, Boarding & Lodging, Hotel etc. “supplier” and therefore your reservation shall be subject to Additional terms of use. You acknowledge that some Suppliers may require you to present a credit card or cash deposit upon check-in to cover additional expenses during your stay. Such deposit is unrelated to any payment received by Trans n Trip for Services booked by Trans n Trip. You acknowledge that Service Providers may require you to sign their liability waiver prior to participating in the service and/or activity they offer. You understand that any violation of any such supplier’s rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable travel product or services, in your forfeiting any monies paid for such reservation(s), and/or in our debiting your account for any costs we incur as a result of such violation.

Bookings made by you through Trans n Trip Website/Offline, Trans n Trip will only act as an intermediary between you and the service providers, and you agree that the contractual relationship will be directly between you and that service provider. Trans n Trip’s sole role and responsibility is to transmit the details of your reservation to the relevant service provider (“Service Provider”), and send you a confirmation by email or otherwise for and on behalf of the relevant service provider. Payments for all Bookings will be in accordance with the terms and conditions set out by the Service Provider (“Service Provider’s Terms”). You agree to be bound by the Service Provider’s Terms, which could include (but not limited to) the Service Provider’s rules regarding use of service of Service Provider.

PRIVACY POLICY

Trans n Trip has a strict Privacy Policy, which you may access from the following link http://transntrip.com/ as well as clicking “Privacy Policy” on the website or mobile application. Before creating an account on Trans n Trip Website, it is mandatory that you read the Privacy Policy. By creating the Log in Account on Trans n Trip Website it shall be deemed that you have agreed to the Privacy Policy of Trans n Trip. Trans n Trip’s software on its Website and Mobile Application may access your location for certain services including providing hotel information around you, availability of taxis, weather conditions, places of interest etc. Trans n Trip shall in certain cases share your location with Service Providers such as Taxi Services etc. for coordination and management.

USAGE OF PERSONAL INFORMATION BY Trans n Trip

You hereby grant permission to Trans n Trip to access and use your personal information such as Name, Address, Phone Number, Email in relation to the services of Trans n Trip and also to disclose the same to the Service Provider/Hotel Owner for the purposes of Hotel Booking and Invoicing. Your personal information may also be used by Trans n Trip only for the purpose of News Letters, or promotional messaging in relation to Trans n Trip products which may be disclosed to its Contractors/sub-contractors for the purposes of sending promotional messages regarding the product/services offered by Trans n Trip and Third Party Service Providers.

PAYMENT METHODS

By booking with or through Trans n Trip Website through secured log in to the website or Mobile Application, you authorize the Trans n Trip and its agents and service providers to transact with your bank or other payment gateways on your behalf to obtain the necessary information required to process payment, confirm payment, resolve inquiries and billing disputes, and/or as otherwise required to manage the booking.

Trans n Trip accepts all cards with MasterCard or Visa or RuPay branding, and other payment methods including Mobile Wallets and Mobile Money such as Paytm or PayU or Gpay etc., which your issuer allows you to use to make purchases online. You shall not provide/share your online banking user name or password with any Trans n Trip Agent. You shall be solely responsible for making online transaction through your secured log in account. Trans n Trip Companies do not want any information regarding your Account Access Data and you agree not to provide us with your Account Access Data.

CANCELLATION & REFUND

You understand that the bookings made by you are non-refundable and are subject to refund policies of the Service Providers. Trans n Trip facilitates reservation on as is where is basis and without any cancellation policy or refund policy. Trans n Trip or the Service Provider shall not make any cancellation once the booking has been done, nor it shall entertain any request for refund.

LIMITATION OF LIABILITY AND DISCLAIMER

Trans n Trip has taken adequate care and precaution to provide error free and updated Information, Software, Products and Services published on this Website. However there may be instances wherein include inaccuracies or errors, including pricing errors may have crept in. Trans n Trip does not guarantee the accuracy of, and disclaim all liability for any errors or other inaccuracies relating to the information and description of the hotel displayed on this Website (including, without limitation, the pricing, photographs, list of hotel amenities, general product descriptions, etc.). In addition, Trans n Trip expressly reserves the right to correct any pricing errors on our Website and/or pending reservations made under an incorrect price. Any software that Trans n Trip may make available to download from this Website ('Software') or through your mobile application store, including the mobile application “Trans n Trip – Best Travel Company” (the “Mobile Application”), is the copyrighted work of Trans n Trip. Your use of such Software is governed by the terms of this Agreement. Before installing the Software, you shall be asked to read the Privacy Agreement as well as this Terms & Conditions. You must accept to the Terms and Conditions after reading and only then you shall install the software. For any Software made available for download on this Website not accompanied by a License Agreement, we hereby grant to you, the user, a limited, personal, non-exclusive nontransferable license to download, install and use the Software and/or the Mobile Application for viewing and otherwise using this Website and/or accessing the content and information available within the Mobile Application (including, without limitation, price and availability of travel services) in accordance with these Terms of Use and for no other purpose.

Please note that all Software, including, without limitation, all HTML code and Active X controls contained on this Website, is owned by Trans n Trip and is protected by copyright laws and international treaty provisions. Trans n Trip is holds the Trademark Rights over “Trans n Trip” as well as the Logo, catch phrase, Slogans, etc. Any person found to be using IPR of Trans n Trip in any manner and without express permission of Trans n Trip shall be liable for Infringement action. Names of Service Providers are the Trademarks of Service Providers.

WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER REPRODUCTION OR REDISTRIBUTION IS EXPRESSLY PROHIBITED. THE SOFTWARE IS WARRANTED, IF AT ALL, ONLY ACCORDING TO THE TERMS OF THE LICENSE AGREEMENT.

Trans n Trip, may in certain cases terminate your login account in its sole discretion, or limit your access to the Website and/or terminate the accounts if you are found to be violating any law, or found to be in breach of the terms and conditions of usage of this website, or for any fraudulent activity through your Login Account, or if Trans n Trip receives any complaint or information from any person that through your Login Account any fraudulent activity has taken place. In certain cases Trans n Trip may also inform the police and file appropriate complaint against you.

JURISDICTION

This Agreement is governed by the Laws of India and is only subject to the Jurisdiction of Varanasi Court.
